By accessing or using Oyster Common AI ("Service"), operated by Demersal, Inc. ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you do not have permission to access the Service.

Oyster Common AI provides an AI-powered platform that offers information about sea farms and related products. Our Service may include subscription plans that provide varying levels of access and usage.

Payments are processed through our third-party payment processor. All subscriptions automatically renew unless canceled before the renewal date.

5. Data Processing and Third-Party Services

You acknowledge and agree that Demersal, Inc. may process your data, including personal information and user queries, using third-party services and AI providers to deliver the Service. This processing is necessary for the functionality of our platform.

You grant Demersal, Inc. and its service providers a non-exclusive, worldwide license to use, store, process, and transmit your content and data as necessary to provide and maintain the Service.

6. User Content and Conduct

You retain ownership of any content you submit to the Service. However, you grant us a non-exclusive, worldwide license to use, reproduce, modify, and display such content for the purpose of operating and improving the Service.

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on any third party's intellectual property rights
  • Transmit harmful code or attempt to compromise the security of the Service
  • Engage in any activity that interferes with or disrupts the Service

9. Indemnification

You agree to indemnify, defend, and hold harmless Demersal, Inc., its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.

While we strive to provide accurate information, Demersal, Inc. does not guarantee the accuracy, completeness, or usefulness of any information provided through the Service. Any reliance on such information is strictly at your own risk.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

14. Arbitration

Any dispute arising from or relating to these Terms or the Service shall be resolved by final and binding arbitration. The arbitration shall be conducted by a single arbitrator in the state of Delaware, in accordance with the rules of the American Arbitration Association.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
